REBUFFED CAR LOAN SEEKER DRIVES DOE TO COURT: D.C. District Court Judge
Ketanji Brown Jackson will hear arguments today over a six-year-old dispute related to the
Energy Department’s auto loan program. Limnia Inc. applied to DOE’s Advanced
Technology Vehicles Manufacturing loan program as well as the agency’s 1703 loan
guarantee operation back in 2009. But was turned down for not meeting the eligibility
criteria during the first phase of the ATVM review and amid a dispute over the 1703
application fee. Limnia argues that it’s entitled to compel agency documents that might
demonstrate the “political cronyism that taints DOE’s decision-making” (Note that the
infamous Solyndra loan guarantee was doled out under a different DOE program). DOE, of
course, denies any political unsavoriness and has pressed the court to have Limnia’s
application sent back to its loan office for another look — a “voluntary remand.” The case,
XP Vehicles et al v. DOE, is being heard at 10:45 a.m. in the E. Barrett Prettyman Courthouse.
